SILVER Hill campaigner Kim Gottlieb says he will take further action against his own council if it does not change its stance.
Cllr Gottlieb last week won a stunning High Court victory when a judge agreed with him that the council had broken procurement law by not allowing the city centre redevelopment to go out to tender.
Cllr Gottlieb, a Conservative member of the ruling group, says the whole planning permission for the scheme for shops and flats is now unsustainable.
He said: “I have made it clear I won’t hesitate to take further legal action if the council comes up with new angles.”
Cllr Gottlieb was referring to the council suggestion that the planning permission granted last December is unaffected by the High Court judgement.
He has written to secretary of state Eric Pickles urging him to call in the scheme.
The council has said it is considering its position and may appeal the ruling.
